my car was transported by Direct Auto Transport. car damaged & personally driven by carrier with no insurance.?
It took 21 days to be delivered. The company had no idea where my car was & the driver kept lying and changing delivery time ten times. Found receipts (restaurant, etc.) in my car, 100+ miles driven, car damaged. The carrier doesn't have insurance & answer the phone. Direct Auto Transport who put me in this worst situation by letting the uninsured carrier transport my car told me use "small court claim" because nothing they can help me out. I am sure small court claim won't help anything so looking for legal action against Direct Auto Transport & the carrier. Any legal advise will be appreciated.
Your insurer should cover any damage done to the car. The insurer would then go after the transport company for the damages. That's what you pay insurance companies for, to repair any damages the car receives from whoever.
1. Being late or not having a proper delivery time is not against the law.
2. Eating food in your car is not against the law.
3. For them not to have insurance, a cop needs to pull them over and ticket them. Nothing you can do about their lack of insurance as a private person.
4. Them not answering the phone is not against the law.
At best, you have a consumer complaint against the company for not doing the job as would commonly be expected. I see no breach of the law that would enable you to win in any court.
Call your insurer to discuss the damages and next time choose a better transportation company.

Now that most states require a certain level of car coverage for you to drive legally, buying auto insurance is no longer something that you can put off or refuse to do. Check the Better Business Bureau and the online insurance forums to find out about the service quality of the various companies.
The amount of service, and where it can be obtained, may also be important to you. That is, if you are a busy professional who travels a lot, it may be important to have an insurer with a national office network, its own claims centers and people who will make your claims process a fast, efficient one. Again, if you don’t mind handling all the details yourself, in exchange for a lower policy premium, then that will affect your decision.
When you need roadside assistance, have to file a claim, or have any other problem, you want to know that you can reach someone day or night, weekend or holiday. Larger companies normally have call centers staffed around the clock. You want to know that your claim or other service request will be handled swiftly, effectively and, of course, professionally. Statistics for claims processing are often available on a company's website, and you can always request this information directly.
